    Call for DNA typing

A little more than a week ago, somebody of the Hambach Forest activists was asked by the Amtsgericht (District court) of Aachen to provide voluntarily the own DNA.
They write, that the reason for this are alleged criminal offenses in the Hambach Forest. If you (or someone you know) also gets mail with such an invitation, contact in any case the AntiRepressionsgruppe Rheinisches Revier / Antirrr (Anti-repression group Rhenanian mining area ) or lawyer Christian Mertens before you answer.

Info Event about “Operation Fenix” on the meadow

FENIX DID NOT RISE FROM THE ASHES

For over 16 months the anarchists and others from so called Czech Republic have been facing the biggest police crackdown in recent years. The operation Fenix isn’t only the wave of repression. For the first time we are facing police entrapment, provocation, fabricated plots, and historically first “serious” accusation of terrorism. Why is all of that happening right now? Is the repression really the responsibility of the most militant part of the movement and does it help if we step back, or is there any other lance and way to deal with the authoritarian power of the state?

Come and join an ⒶBC reflection of one and a half year of accelerating repression and our reaction. Let’s talk about our protection and share some experiences of how to prevent falling into the trap. Now when the first court hearings are happening is especially important to see what kinds of solidarity actions we can provide to empower ourselves and keep our community strong instead of getting paranoid and paralysed.

The Talk will be mainly in English with a whisper translation into German.

4th of November, 7pm, Hambach Forest

Note from the owner of the meadow

In the lawsuit against the state of North Rhine-Westphalia, applying for a declaration of invalidity of the zoning decision concernng the relocation of the motorway A 4, the Federal Administrative Court has set the hearing date at

    Wednesday, 22 March 2017 10:00

in the courthouse Leipzig, Simsonplatz 1, 04107 Leipzig, – courtroom IV, 2nd floor, room 2-030.

RWE wants the meadow: voluntarily or by force!

According to the owner of the meadow, RWE Power AG demands the approval of the sale of the meadow including the protest camp. If this consent is not obtained, the area including the protest camp will be expropriated (“Grundabtretungsverfahren”).

He says that a talk is to be conducted in the presence of the legal advisor of RWE Power AG. Then everything will be discussed in more detail. If the discussion is refused, the expropriation proceedings shall be initiated. On threat of this delicate evil (§ 240 German Criminal Code: coercion) the owner of the meadow has agreed to talk with representatives of RWE Power AG..

A proposal of the owner of the meadow for a meeting in November, after the hearing of the action brought against the 3th basic operating plan Hambach before the administrative court in Aachen was rejected. They said it was too late. It remained unclear why.

Then a talk was fixed for Friday, October 07, 2016. Representatives of the meadow have the right to participate in this discussion and are invited, because their interests are directly affected.

The owner of the meadow does not understand why RWE must have the meadow including the protest camp already now, although the meadow will not be used for the open pit until about 2022 to complete and the pending litigation against the relocation of the A 4 and against the 3th basic operating plan Hambach, the open pit Hambach still at any time could be stopped completely and according to interim measures.

    Clumsy is free!

There is news of our compa Clumsy, who was arrested during the LAutonomia eviction. He was alleged to have chained himself together with three other people on the railway to the lignite power plant “Schwarze Pumpe” in order to prevent the coal feed. Another allegation was on trespassing because of the LAutonomia occupation.

Today, Wed. 07/20/2016 at 9 am, was the continuation of his trial. At the end Clumsy left the courthouse as a free one. On the sanction imposed by the judge of 120 days or 13,- € per diem will be taken into account the time (almost 6 weeks), which he spent in custody until the beginning of the trial last Tuesday, due to a risk of absconding. We are happy and we hope we can welcome Clumsy soon here in the Rhineland.

    What happened before:

Report by ABC Dresden about the first day of the trial against Clumsy on July 12, 2016. Next date is Wednesday, July 20, 2016, 9 am, again before the Landgericht in Görlitz. Come numerously! Probably there will be again a high police presence and ID checks at the entrance.

Background info: J. had rappelled at the EndeGelände action day 2015 from a motorway bridge to enable the so called Blue Finger access to the open pit (their path crossed said motorway, which was free of cars hence and could be crossed without risk by walking people. Thus, J. made a great contribution to road safety).

Show Solidarity – Trial on 12 July in Görlitz

The activist Clumsy has been in jail now for approx. six weeks. The trial will take place on July 12th. He is accused of having locked himself to the railway tracks of a coal train to the power station „Schwarze Pumpe“ at Ende Gelände this year. After a short arrest he had at first been released, while some days later on the eviction of the tree occupation LAUtonomia he was newly detained. Since then he is in pretrial detention because of the supposed danger of an escape. The allegation for the coming trial is “Störung Öffentlicher Betriebe” in conjunction with Ende Gelände, which means a severe case of “disruption of public facilities”. (more…)

Update: E* sentenced in Norway to 45 days in jail

This mail has been sent to us:

    „Heya,

Here is an update from Norway, E from Cistem Failure has been sentenced to 45 days in jail for throwing a pie.

    The Situation

On Saturday, the 25th of June, E from Cistem Failure was arrested at the Pride Parade in Oslo, for allegedly throwing a pie in the face of the Norwegian Minister for Equality, who was marching at the front of the parade. The Norwegian police and media called it an attack on democracy. They were held over the weekend until court the following Monday, at which the state asked (and the judge granted) for them to be held on remand in custody until their hearing. (more…)

    Appeal hearing: abatement of action!

DIY or dieAachen, July 01, 2016 – The case against Basti has been set today after several hours of hearing. He renounced compensation for having served innocently a custody of about a month and is now free without conditions.
Numerous supportive listeners were present, however, the involvement of the police and state security in the court was far more numerous. Two security gates together with identity checks caused delays in the start of the trial. There were no incidents.
The hearing took place similar to the first day of the first trial. There were two invited witnesses, both then working for RWE as security agents. Both witnesses had seen something, but could not confirm whether it in fact was Basti who struck the security guard, which led to the first instance sentencing. Both pretended that they heard this from the other one. Ultimately, the second witness testified to have seen that a stick had been raised. He later learned that his colleague allegedly was beaten and then guessed, that was what he claims to have seen. “A knallzeuge”, the judge, prosecutor and defender evaluated unanimously in the final talk. In legal terminology a knallzeuge (bang witness) is somebody who e.g. only heard the bang and then believes to be an eye witness.
The first witness (who had stated to have been injured) had seen Basti with a stick in front of him. However, he then got (from the other side) pepper spray in his eyes, after which he had to close them for several minutes. In this time he got the blow, he testified. The inquiring prosecutor noticed, that he impossibly could make any observation whatsoever.
There were numerous other inconsistencies that were more than clear already on the first day. It probably will remain a secret of that judge, why the trial at first instance ended in a conviction. Final word of the second witness: “In fact nothing happened at all, nobody was hurt, except for the pepper spray I do not understand why they made such a big thing out of it.” Almost nothing more is to to add. With his incident, however, started a long series of repressions against activists of the Hambach Forest. For Basti 20 months of repression in this matter are over now. (more…)

    Call for Solidarity from Norway

We received this mail from Norway!

    E. from the Band Cistem Failure is sitting since last weekend in Norway in jail, accused of an attack on democracy (ie a cake in the face of the minister for gender equality) The court hearing will be on Thursday

If you like to, please write to:
    E, c/o Oslo ABC, E, Postbox 6689, 0129 Oslo, Norway
Then they will forward it to E.
    More: ABC Rhineland

Last weekend, E from Cistem Failure got arrested during the gay pride in Oslo.

Unexpectedly, the cops are making a big deal out of the whole thing. E was held in the police station over the weekend before being brought to court today. The judge decided today not to release E, so they are currently being held on remand in custody until their hearing, which must happen in the next 28 days.

At the hearing it will be decided if they are guilty or not and what their possible sentence will be (their lawyer expects between 20 and 40 days in prison). However, the time they spend in prison on remand will be subtracted from their final sentence. So if for example they wait 20 days until their hearing, and then get a sentence of 20 days, then they will have already served their time.

They have been charged under Straffenloven § 128, for hindering a state official from carrying out their work. They are accused of throwing a pie in the face of Solveig Horne, an asshole, sexist, racist politician from the right-wing Progress Party, who had the cheek to march in the front row of the Pride parade. She is the Norwegian Minister for Equality, Children and Social Inclusion. She is known for her victim blaming, and has in the past said has made homophobic remarks such as „Is it okay that kindergartens read gay fairy-tales for young children?“. The Progress Party are a known racist party that gives zero fucks about refugees.

Anyway, we think it is strange that in general politicians are leading Pride, have they forgotten about Stonewall? People can have Pride as long as it means assimilating into capitalism and shit. I mean, why be homophobic when queers also have voting rights and have money to buy things with? The gay pride in Oslo gave the equality price this year to the police…

Anyway. They are gonna be in jail for a bit and it would be cool if peeps would send letters, talk about the case, play our music, do a soliparty, write a song. If you want to know more or get updated, or do something or just have chat you can email this address.

You can send letters (until we have a better address) here:

    Postboks 6689 St.Olavs plass

Until then, none are free until all are free.

    Yu is free!!

Yu, an activist, who was arrested at a railway blockade of EndeGelände and detained for 5 weeks because not stating identity, was released today by stating their identity.
More info at the web site ofLAUtonomia and ABC Rhineland.
    We are very pleased!

    Zottel is free!

    ⒶBC Rhineland writes:

Surprisingly, our friend Zottel was released from imprisonment on remand in Görlitz yesterday. He was one of the two activists who were arrested after the eviction of LAUtonomia because of a lock-on-action during the Ende-Gelände action days. We still don’t know the reasons for his release.

The imprisonment of the two activists after the eviction was a new development in the repression against the climate movement. For the first time, imprisonment on remand was used although their identities were clear.

Zottel is free now, but the activist who was arrested with him and our friends Yu and Turtle are still imprisoned.

Until all are free, no one is free!
